Case Timeline
Where Carlos says due process failed
These are the questions his account raises. They are campaign positions and attributed claims, not findings.
Service
Carlos says warrants issued against him since 2024 rest on “an inexistent service of process service,” given that he had already lost his home.
Notice
Carlos says he has been detained more than once, often without the opportunity to see a judge for many days, and without being properly served.
Judicial Authority
Carlos says he was held for one month in 2024 without having committed a crime or been judged by a superior court.
Findings of Willfulness
Carlos says he was forced to pay approximately $15,000, and that the court failed to consider the payment receipts made in favor of his children's mother and his children.
Right to Present Evidence
Carlos says the court flatly refuses to admit his evidence of payments, including past and present receipts for the nanny and school tuition.
Conditions of Confinement
Carlos says he was held in the maximum-security unit for dangerous criminals, in segregated individual cells in a freezing ward with no heating in winter and no ventilation in summer, in an area he understands had previously been ordered closed.
Medical Care
Carlos says he became ill in custody and was given medications for serious blood-related medical issues, and that on release he experienced bleeding from his nose, mouth, and eyes.
Parental Rights
Carlos says the mother relocated his children to Florida without his authorization and has begun another lawsuit there, a state where he does not reside.
The Money
Carlos says the mother of his children, Mrs. Espana Aristi, stated that Child Support Enforcement did not give her that money and took about 75% of it, leaving her nothing.
WHEN A FATHER'S RECEIPTS ARE REFUSED
The campaign's position is that a court which will not admit evidence of what a parent has actually paid cannot make a lawful finding about his ability to pay, and cannot lawfully lock him for the difference. A payment is either on the record or it is not. Refusing to receive the evidence and then charging the person with not having paid is not a hearing.
Impact on his children and family
Carlos's letter describes children he says were moved to Florida without his authorization and kept there against his explicit will, a mother he says contacts him only when demanding money, and a father he says is now receiving social services assistance while living in shelters, sleeping on the streets and going hungry in order to remain present in his children's lives.
